Charter Terms and Conditions

1. GENERAL TERMS

  • By booking a charter with Turn Charter ("the Charter Company"), the Organiser and all guests agree to comply with these Terms & Conditions. Failure to adhere to these terms may result in termination of the charter without refund.

2. RESPONSIBILITIES OF THE ORGANISER

  • The Organiser is responsible for ensuring all guests understand and comply with these Terms & Conditions.

  • The Organiser assumes liability for the conduct, safety, and adherence to rules of all guests during the charter.

  • The Organiser shall communicate all Charter Company policies, safety instructions, and relevant laws to their guests.

3. ALCOHOL & DRUG POLICY

  • Moderate alcohol consumption is permitted for guests of legal drinking age. Excessive consumption, intoxication, or disruptive behavior will not be tolerated.

  • The possession, use, or distribution of illegal substances is strictly prohibited and may result in immediate termination of the charter without refund and potential legal consequences.

  • The captain and crew reserve the right to limit or prohibit alcohol consumption if it compromises safety or violates any laws.

  • Guests assume full responsibility for their actions while under the influence of alcohol or other substances and release the Charter Company from any related claims.

4. SAFETY & COMPLIANCE

  • All guests must adhere to safety instructions provided by the captain and crew.

  • Life jackets and other safety equipment must be used as directed.

  • The Charter Company reserves the right to terminate the charter without refund if guests engage in reckless behavior, fail to comply with crew instructions, or violate legal requirements.

5. DAMAGE & CLEANING POLICY

  • The Organiser assumes full financial responsibility for any damage to the vessel, equipment, or property caused by them or their guests.

  • The Charter Company will assess damages after the charter and provide an invoice for repair or replacement costs, payable within seven (7) days.

  • If excessive cleaning is required (e.g., spills, stains, broken glass), a cleaning fee of $250 will be charged.

  • If a security deposit was collected, any damage or cleaning fees will be deducted, with the remaining balance refunded.

6. LIABILITY WAIVER

  • The Organiser and all guests acknowledge that participating in the charter involves risks, including but not limited to injury, property damage, or unforeseen incidents.

  • The Charter Company is not liable for any loss, theft, or damage to personal belongings brought aboard.

  • The Organiser and guests release and hold harmless the Charter Company, its employees, and affiliates from any claims, damages, or legal actions arising from participation in the charter.

7. INDEMNIFICATION

  • The Organiser agrees to indemnify and hold the Charter Company harmless against any claims, liabilities, damages, or legal expenses resulting from the actions of the Organiser or their guests during the charter.

8. PHOTO & VIDEO RELEASE

  • By participating in a Turn Charter experience, guests grant permission for the Charter Company to use photographs, videos, or other media taken during the charter for marketing and promotional purposes.

  • No compensation will be provided for the use of such images or videos.

  • Guests wishing to withdraw consent must provide written notice before the end of the charter.

9. CANCELLATION & REFUND POLICY

  • Cancellations made 30 days before the scheduled charter may be eligible for a refund, subject to the Charter Company's policies.

  • No refunds will be issued for cancellations due to guest misconduct, failure to adhere to safety regulations, or violation of these Terms & Conditions.

  • Weather-related cancellations are at the discretion of the Charter Company, and rescheduling or refunds may be provided on a case-by-case basis.

10. GOVERNING LAW

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising under this Agreement shall be resolved in the courts of British Columbia.

11. ACKNOWLEDGEMENT & ACCEPTANCE

  • By booking a charter with Turn Charter, the Organiser acknowledges that they have read, understood, and agree to comply with the terms outlined above.
